As India becomes one of the fastest growing economies in the world, the need for a robust alternate dispute resolution mechanism that instils confidence in international players is paramount.  Historically, India’s approach to enforcement of awards and dealing with international arbitrations has been checkered, but the recent notable amendments to the Indian Arbitration Act have once again indicated the legislature’s intention to boost investor confidence and to promote business and investments.  Understanding the country’s approach to international arbitration is key to the success of any organization looking to benefit from a successful India play.
